While well-intended, you didn't review the legal aspects before promising a reward to specific people. What you're trying to accomplish is a violation of the TIA Privacy Policy. Namely,

What they can do is have the TIA email the voters. That would make sure they aren't being given to Funko thus not breaking the privacy policy as you gave them your email.

I am unable to find any part of Brian's statement which leads you to believe they will be violating the TIA Privacy Policy. While I am sure you have nothing but the best intentions in your cheerful and informational post, I am willing to bet they will be researching the best and most legal method of distributing these Freddys. I could be wrong but then again who am I to doubt someone who has turned Funko into a company with almost half a billion dollars in revenue last year?

Personally I think the gesture is obviously well intentioned and cool but I did wonder about the logistics involved, legally and otherwise. I work a corporate gig with a lot of lawyers and this IS the kind of thing that could be a slippery slope...and it's ok to say so. I'm also pretty sure this was taken into consideration by Funko, but I think it's also fair to raise the question. If anything the wet blankets in life are necessary if for nothing at all to serve as means to appreciate that it's all a bit more complex than we like to think it is for a company like Funko to keep their fans happy and still do things on paper the proper way.

I don't necessarily see anything bad about bringing up the legal side of the situation but I do think A, it could've been brought up with a more...pleasant demeanor and B, I highly doubt a growing company like Funko hasn't thought about these things. Not to say it's not possible but seems doubtful.

Agree 100% No major company would do anything that could harm their business. Just like Funday's it's Funko's way of giving back and bringing the Funatics all the fun possible. While I think there is a lot of people that are sorry they didn't vote. Me and a lot of other people voted not knowing we would be rewarded for it but because Funko brings fun to us all. And it was our voice being heard saying we think they deserve the award. In my opinion Brian has done nothing but good things and gives back every chance he has. Now even if I don't get anything and yes I voted and posted it here on the boards when I voted. That's fine with me it does not change the fact that Funko went from a tiny little company to their huge 70,000 sq ft new building in Washington and their products can be found in almost any store you go into. Again Brian and all of Funko staff deserve the award and nothing can change that. Now if I get the Freddy fine if I don't I will still live and continue to buy Pops, t-shirts and other things I like :freddy3: :freddy3:

I was wondering about the legalities as well, and you make a very good point. TIA could very well send an email to the voters with a link to a survey or something.

Either way, I'm sure Funko has everything worked out. They seem to know what they're doing lol

I agree that the gesture of giving those who voted for Funko Pops a gift is only with good intentions, I can also see the potential ethical and legal ramifications around that. With the knowledge that Funko gave gifts to those that voted for them this year, would that motivate people to vote for them next year strictly in hopes of a free gift? I don't recall in any situation where people voted for a particular company, person, etc. and the nominee who won or even was nominated gave a gift to those who voted for them - at least publicly announced. I'm no lawyer nor do I specialize in situations like this, just my opinion. I do hope Funko can share the Holo Freddy's as a gesture of appreciation with the community, it would seem to be a bit sketchy to only share with those who voted for them. They could just make a certain amount available on funko-shop, limit one first come, first serve for free. I am certain I did vote- if I did or didn't receive a gift it wouldn't change me impression of Funko. I enjoy the products they put out and their connection with the community through social media and forums like this one. As others have said, they are a large company and have thought this through. To even offer this is awesome of them!

I enjoy the products they put out and their connection with the community through social media and forums like this one. As others have said, they are a large company and have thought this through. To even offer this is awesome of them!


Good point, never thought of it that way. I am thinking they are in the clear with it being a thank u after the fact, so not a bribe. It may motivate ppl next year but they wouldn't know before voting, could very well be a one time thing

I think people in general tend to be a little lazy – if you ask them to click on something, they'll most likely do it. But if they also have to enter in an email address, it suddenly becomes too much work for them lol That said, those same people might be a little more motivated to vote next year knowing a thank you gift was involved in the last round of awards. So I don't think that giving something away now would necessarily change anyone's votes. I do think it will inspire more people to vote for Funko who probably would have anyway (but in the past they were too lazy to). If that makes sense.

I also think it could inspire flippers to vote funko in the future as well. We know flippers will do anything to make a buck!

I definitely agree to.some extent with those posting concerns about the legal/independence side of this. I think there are ways to structure it appropriately and just hope funko has thought it completely through to avoid any potential negative consequences. I'd hate a gesture like this to blow up in their faces. It definitely has the potential to.

The website said that the info wouldn't be shared with third parties. But would Funko be considered a third party? Given that they were part of the process, one of the companies nominated/included, I wouldn't think of them as a third party. I'm unsure as to legally whether they would be considered a third party. If not, then the info (email address) could be shared with them legally. Or, as others have suggested, TIA could send an email on behalf of Funko.
